Lads.....

The zxr is dead. A nice car driver decided they wouldn't look in there mirrors. Numerous bikers ahead were filtering around the car which was positioned over to the left. It looked like they had pulled over to check a map or take a piss etc. As I went to filter passed they turned right into a no public access road (to do what I think was a cheeky u-turn), across my path. I tried to avoid her but she just carried on as usual. I was braking but I can distinctly remember thinking "if you get on the horn, she'll see you and you'll just get passed" Which obviously didn't happen. The bike hit the wheel arch and I carried on Lorenzo style doing several flips and landing on my back resting up against a fence.

Most of the pics were taken by others but I have a few...

Soo glad you walked away from it Scot! it has scared the sh*t out of me! didn't think i was gonna make it tbh, i'll upload a few more pics later.

That's shocking news m8, was such a nice bike! At least you came out ok though.

Nah, the frame is twisted and cracked, the forks are bent, the front wheel is smashed and half of it is sitting in the radiator. The engine may be siezed and every fairing is smashed.

yeah i was there, and jamz and Gemini, and a few others, we went out for a rideout yesterday and unfortunately this happened.

Yeah, unfortunately what you couldn't see was we were taking avoiding action around her when she was slowing to make the turn... I can't believe she STILL turned even after that! :smt013

To make it worse she didn't seem to give a damn, either...

Gutted for you and the bike! :smt009

must admit i've been riding for 10 years and this is as close as it gets, i am a bit shocked by the whole incident to say the least.Not gonna stop me riding but certainly makes you think.

Well in 2006 an appeal court judge stood the whole thing on its head. In Davis vs Shrogin, the judge found that, and I quote, "a filtering motorcyclist passing stationary or very slow moving traffic could not be to blame if a collision occured if the rider had no chance to take avoiding action."

They're stationary, the biker is totally in the clear. And if one of them makes a U turn and knocks him off, they're 100% in the wrong...In other words, if you are filtering past traffic which is stopped or almost stopped and someone pulls out in front of you close enough that you can't avoid a collision when travelling at a reasonable speed then the resposibiltiy for the collision rests squarely with the other driver.

Ladies and gentlemen, filtering past stationary traffic is no longer a grey area - it's completely legal. It gets a little iffy when the traffic is moving at more than a crawl - that still is a grey area. And once things are moving along properly the you're breaking the law when you filter.

Obviously I'd still earnestly recommend that you engage the services of a good, bike savvy solicitor (try calling Plantec on 0870 284 3431 for someone who will handle all the rest of the hassle as well) but knowing that one little phrase - "Davis vs Shrogin" - could make a huge difference to the outcome. Or even, if your solicitor isn't as switched on as they might be, to the approach they take.


It's not entirely the same thing but may well be close enough! It was a 60 limit road with no oncoming traffic, and if you point to the damage done to her car being relatively little that should be taken into consideration that you were travelling at 'reasonable speed', which on this road at that time would be anything below 60mph...

If you get Shoosmiths 'handling' your case fk them off straight away and get in touch with some specialists...

I think if I were you I'd fight for it.

Glad your ok and walked away from it could of been much worse by the sound of it, least the bike can be replaced!

There seems to be all to much of this with society today, it feels like people dont care about others anymore just wrapped up in there own lives.

Realy gutted for u fella, just as u got the bike lookin bad ass aswell. What was the stupid cow thinking?? It's scary realy when u think of the amount of morons on the road.
Hope it doesn't put u off to much, and atleast your ok.

I don't get how people can't see a bright green and white bike coming past in the daytime especially when another few bikes went past and (you would think) that would prompt her to look for more. Glad to hear you're ok with no broken bones though.
