after i fitted back my tank i have noticed that the gaps on both sides are not really even could it be me putting it not right or could this mean my frame is done?

could mean the tank mounts are twisted too. If the bike goes in a straight line when you let go of the bars then its probably safe to say its straight. Only getting in a jig and measuring up will you know for sure.
