Side stand safety switch question L9 ZXR400.

The side stand safety switch on my bike seems to work fine as in it is open circuit when the stand is down and closed circuit when the stand is up.
But the bike still runs when in gear with the clutch out and side stand down.
The clutch safety switch works fine as the bike won't turn over when in gear with the clutch out but will with the clutch in.
I know it's not detrimental to the bike but I'd rather it worked.
Has anyone experienced the same or can offer advice/fix?
