all i would say if it gets to the solicitor stage is

the driver obviously didnt check her mirrors before starting the manoevre, if she had checked mirrors then she would have seen a bright green bike with a clean white leather clad rider coming up behind her.

if she didnt see you then she didnt check her mirrors and if she didnt check her mirrors before performing a manoevre then she was driving without due care and attention. an endorsable offence, i would know i got done for it.....

but i was wheelying my RVF at the time lol! :pmsl

she aint got a leg to stand on mate, i mean what response could she come back with to defend against that?

if she looked she would have seen you, if she didnt she wasnt driving with due care and attention, you've got her over a barrel mate :smt020

If she was making a u-turn, or even turning right into the private driveway (which was marked as not for public access), then it would stand to reason that she'd also have been doing under 10mph at the time, which means your pass was totally legal and the onus was on her to check her mirrors for anything approaching from the rear.

look what i found scott in you defence for crossing over the solid white lines.....

Highway code states:

129

Double white lines where the line nearest you is solid. This means you MUST NOT cross or straddle it unless it is safe and you need to enter adjoining premises or a side road. You may cross the line if necessary, provided the road is clear, to pass a stationary vehicle, or overtake a pedal cycle, horse or road maintenance vehicle, if they are travelling at 10 mph (16 km/h) or less.

[Laws RTA 1988 sect 36 & TSRGD regs 10 & 26]


send that to the other sides solicitors and wait for the settlement cheque to hit your doormat

having rebuilt my zxr over this winter i know how much effort went in to your bike .iam really gutted for you mate id be hart broken :smt010 that aside at least your ok and can fight another day . hope you get all the shitty claiming out the with out to many problems buy the sounds of things youve got some good witnesses to help you out :smt006 :smt006 :smt006 :smt006

I wasn't planning an overtake though. My plan was to filter passed. However, If they say I was overtaking on double whites then I have this in my defense also. The bottom line is... If she had looked in her mirrors none of this would of happend.

you can read this in many ways .........

She is in the right as she was turning into a side road, Scott, you crossed the lines and were not turning into a side road so are in the wrong.

You may cross the line if necessary, provided the road is clear, to pass a stationary vehicle, or overtake a pedal cycle, horse or road maintenance vehicle, if they are travelling at 10 mph (16 km/h) or less.

her car was not stationary (even tho you thought it) and it was not a cycle, horse or Road maintenance vehicle therefore you were in the wrong again

From witness statements i'm sure they will see that Jamz and myself overtook her to avoid collision but wayne, paul & gem had stopped therfore you should have had time to stop.

not trying to be negative just giving thoughts for you to prepare yourself, i can see this being a long drawn out case. hopefully for you it wont be and with all the witnesses on your side you will and should!! win this case.

Well before you turn right you should

* use your mirrors to make sure you know the position and movement of traffic behind you
* give a right-turn signal
* take up a position just left of the middle of the road or in the space marked for traffic turning right

And what was she doing down that road anyway.

Anyway, this being a public forum I'd rather we not get into a discussion about right and wrong etc. Got pleanty of that to come.

you got her by the balls there mate :-) cos i never saw her signal until the last second and she slammed her brakes on to the point i nearly ended up through her back windscreen if i hadn't took evasive action, can't see how she can fight this.

Another point being.... In that solicitors letter, They wrote...

"....are that you hit the claimaments stationary motor vehicle."

Which is false, I hit it when moving, but they are admitting to be stationary at some point.
