Hier,
I got to take off me downpipes soon and take off the surface rust/repaint. Do I need new gasket set, or can i get away with the old one
new exhaust gaskets?

9/10 times YES
If you want to go cheap, heat the old ones gently with a gas torch or over your stove and re-use.
When you use new ones dont go heavy handed tightening up the exhaust flange nuts and you can use them several times - thats what I do as I change exhausts on both bikes regular

Nothing worse than having an H and not being able to scratch it !

been reuseing em for years never bought new ones yet
