Re: Bad news...
because of the brain injury they want to "give me time to recover properly". Can't really blame them I guess...

Yeah, it's not great it being sat there every time I go in the garage. And I can't even get to work on it to pass the time until my claim is sorted. Feeling better though, having physio for the shoulder and getting weekly visits from a brain injury nurse but other than misplacing 3 weeks of my life that I can't remember I'm getting betterSOILZX wrote:Dude..................................... Re: Bad news...
Quick update - insurance want nothing to do with it as I wasn't fully comp and there's no other vehicle to claim on. Therefore it's now a civil case that I've got to sort out myself, but they reckon I may not be able to claim as "just because he owned the cow doesn't mean he was responsible for it's keeping as it could have been someone else fault it got out". This may take some time....
Also took some more pics when I was in the garage the other day:

Re: Bad news...
Insurance are copping out there, weather it was the farmers fault or not the cow got out, its his property and therefore his responsibility that his live stock remain secure, there must be rules on that? Im sure they wouldnt be saying this if a heard of cows got loose on a motorway and caused a death.

Completely agree, but sadly the law isn't always fair or sensibleRedexRobB wrote:weather it was the farmers fault or not the cow got out, its his property and therefore his responsibility that his live stock remain secure, there must be rules on that? Re: Bad news...
How do, cheers for asking.
A fair bit has happened actually. Another accident happened about 20ft from where it happened to me at the end of last year. Turned out to be the same farmers cow. And the same individual solicitor is dealing with both cases running side by side. Due to this he's admitted liability and his insurance are currently paying for private occupational therapy, cognitive behavioural therapy and neuro-psychologists (i was suffering from PTSD and post concussion syndrome) and a 12 month gym membership to rebuild what I lost physically and lessen the affects of the nerve damage.
My licence still hasn't found it's way back but I've passed the medical examination so should hopefully be seeing that pretty soon. Although being too skint to actually fix the ZXR, i'm not in too much of a rush. Although it would be nice to start having car lessons.
And also, my ice hockey league don't want me to play again, ever, so the SOB is gonna be paying heavily for that one.

Re: Bad news...
Well there's been some progress.
He's at court today as he's still not admitting liability, however his insurance made me an offer to settle before it went to court. I declined.
My licence is zooming it's way back to me now too so we'll see what happens at court
