Road traffic collision, very annoyed. rant

Post by SplaTZXR400 »

Well been riding 2 years now and had my 1st crash. ow it was painful! jus goin out to work on a friday at half 4, only a 10 minute journey so nothing special, well comin out of my village which if any of you know pevensey bay eastbourne road is straight, wide and good visibility. so goin down the road and i see the car comin the opposite way, and was indicating right, or my left across my path.i got about 10 feet within him only doin 30mph and the F****er pulled infront of me very quickly. so wot happened?? i braked hard, skidded then i dont remember. next thing i knew i was on the floor in so much pain. witnesses told me that id hit the windscreen or something and gone over. i was concious the whole time. if i had the strength to say you stupid mother f*****r wot the f**** you think ur doin driving like a tos*** you senile old f****, if i cud get up i wud f****** belt u one and smash ur f***** melon head on ur bonnet!! but like always u think of things to say after the time.

well i have 4 witnesses that came forward in my favour, 2 of them are my old school mates aswell, n 1 of them was goin for the driver, i remember hearing him shouting you stupid f***** tos*** as i lay on the road. they both ride bikes 2. im so angry though coz the crash was not my fault!! wen the driver did get o ut his car apparently he seemed more concerened with his pathetic wingmirror. wot a p***k!! he never came over over to me, never apologised, infact he had the cheek to go up a driver and try get him to lie for him saying i overtook him n the crash is my fault!! i really wan2 smash this guys head in.

advice guys, always wear ur jacket, it helps! and trousers preferably too, n definately wear ur boots!

still though i had undisplaced fracture in mty left wrist, a badly displaced fracture on my right wrist, which was operated on and had 2 b plated and screwed, i have a torn ligiment in my left knee, a broken nose, inured ankle cuts scrapes and many bruises. i hav 3 limbs in cast at the moment. my left handis pretty good so i can type, but my right hand is numb and quite useless as i hav nerve damage.

i am persuing compensation, but dunno how much i can expect, n i will c that this c**t goes down, if the police wont pursue any criminal action then i am. hes not getting away with it.

im not happy with my bike tho, hope its not a write off:
alternator cover is nackered, right rear wing, front fairing, both mirrors, fuel tank, clocks and frame they sit on, the screen, brack frame that supports the fairing, hadlebars and possibly both fork legs. i am not happy!!! all because some old spack cant see.

guys if anyone cuts u up or nearly causes an accident with u then i urge u to pull them over and smash em up. jus to let em no that they shud drive like normal ppl, n if not then the f*****s shud not be drving. coz ppl like that only end up killing other ppl and its not fair, iv heard of so many bike crashes lately n near misses, funny enough all similar to me where car drivers jus dont look n take u out.

well thats my depressing story over, when im better n more mobile i will upload some pics i think. but another 4 1/2 weeks in cast.

ride safe guys n watch out for old senile drivers!!

Alot of people might not know this, but that is actually the most common accident for motorcycles, not people pulling out at junctions. Its when people are facing directly towards you and are about to cross your path :smt011

I take it being Eastbourne and by the way you were talking about him, he was some old fart with bottle lenses for glasses with a blue rinsed wife in the passenger seat?

Thats really toad mate, considering you have 4 witnesses in your favour you have got a very good case already, his insurance companies first move will be to claim no liability, obviously you dont accept that and claim 100% liability providing your details of what happened and a police report of which the police should have taken statements from witnesses. If they still dont budge then you take em to court, its as simple as that. Hopefully its a no brainer and there will be no dispute about liability which is what drags claims out. Good luck with it mate, and heal soon!

Bugger.

Sounds like they'll write the bike off to me, so just concentrate on getting compensated for a new bike and your injuries so you're not out of pocket!

I'd also recommend getting... err... can't remember the name but the BIkers legal aid people.

Sounds like the kind of thing they're good at getting a fast and fair settlement for.

I had an accident on 22nd February 2003 it was 2 months after I had passed my full licence. So stupid b**ch pulled out of a side road in front of me because she was concentrating on her fish and chips instead of the road.

I hit the nearside rear panel of her 205, I didn't break anything as I was only 17 and still bounced. I did however substain a severe head injury which ment I have no memory of a year before or 6 months after the accident.

She accepted full liability and I claimed for my bike, everything I was wearing (and I mean everything down to my backpack, boots and mobile phone) all that money came through pretty quickly and I used it to buy a bigger faster bike :smt003

My personal injuries however is a different matter. At the time I was in the middle of my A-levels studying maths, further math, physics and chemistry, as you can imagine 18 months of amnesia did not help with these. I had already been accepted on the back of my predicted grades to join the RAF, who were going to put me through uni doing a masters in pure maths aswell as training me to fly and giving a decent wage. Now because of my head injury I am not allowed to fly fighter jets :smt009

Because of this huge shock to my plans I had to reconcider what I was going to do, I decided to go with my second passion car/motorbikes and trained with Peugeot as a parts consultant, I won the national Apprentice of the Year award in 2006 before leaving my role to work where I currently am as the sales manager. The original plan was to claim for my loss of earning as I could not follow my intended career path. Now if I had joined the RAF it is predicted that at 30 I would be earning 75k a year at the moment I am 22 (in a week) and earn 25k a year, unfortunately this means that I am still on target to be earning the 75k by the time I am 30, so I have no loss of earinings.

Right still with me?

My solicitor suggested that we claim the cost of me returning to uni, this would mean claiming my wage for the 4 years, it would take to complete my A-levels and the uni course, plus the difference in costs of doing a degree at 22 as oppose to 17. This amounts to well over £100'000. Obviously I don't expect a full settlement and the first offer that came through was for £20'000 I turned this down and am now waiting for a second offer.

Though my solicitor says that it should all be resolved by the end of the year it has taken over 4 years to get this far so I guess what I am saying is don't expect it to happen over night. Although your case may not be as complex as mine it may still take a couple of years.

Good luck though and at least you are still breathing!

Do you mean my name? If so why does that make it doubley harsh? :smt017

If the old fart in the car was also doing 30mph then that would be a 60mph crash. I just crashed my bike aswell but not nearly that bad. Hope you heal soon and good luck with getting the money off the old fart.

I aways find it funny when I wait for my friend at work. I usually wait by a round about and when I stand there for 30 to 40 mins I see at least 4 - 5 possible crashes where car drivers aren't watching where they are going or don't realize they have to give way to the right. I'd love to know how these twats get there licences.

well i spose in thosedays they cudbuy there license rather than be tested for it. i think they shud all be orced to take a proper up to date test. well im 18 n i didn't bounce :smt003 it really hurt, ido wonder how i hit tho coz i hav no memory between braking hard and laying in the road with people over me. i no the front end skidded and slipped, maybe i jus hit it hard rather than goin over. dontwan2scrap my bike though, i love it n its mine n im so annoyed that my pride and joy is ruined by some nob in an x reg toyota corolla. still though depends wot the insurance company will offer for my 1993 with 33,000 miles, il probly buy it back n keep it as a project bike, as the frame and engine all seen untouched, most of damage is cosmetic, but insurance might not c it like that.

well at least il hav stronger wrists now, second time iv broken my left n im slightly bionic in my right :smt003

hope i get decent money tho, dont care how long it takes really but il be happy if i get enough to do my car test, get a car, get it insured, and get my bike fixed, or get a new 1, then go shopping, buy my gf a thanku present n still hav cash left over, that'l do nicely. i mean u c these ppl on tele who get injured, mr x who got 7,500 for wiplash, n that silly cow mrs y who tripped on plastic n probly bruised her knee got something like 9,000!!!! so i should alot more for 2 fractures, loss of earnins, lost my job, pain sufferin etc. aswell as insurance claim for bike n gear. n il find out friday if my nose is broken, it looks n feels it. :smt012

Seriously - don't leave it up to your insurance company!

Insurance companies are out to settle for as little as possible - get in touch with the bikers legal aid thingy and they'll take over.

Somebody must know what I'm talking about here?
